In the petition, the Varanasi court’s direction to conduct a comprehensive survey of the Gianavapi complex on April 8, 2021 has also been challenged.
On December 8, Justice Rohit Ranjan Agarwal had reserved his judgment after hearing both sides – the petitioner AIM, which manages the Gianavapi Masjid, and the UP Sunni Central Waqf Board, and the respondent, the Hindu side.
The lawsuit filed by the Hindu side claimed that the mosque was built on an ancient Shiva temple and demanded its restoration.
However, AIM claims that the case is inadmissible under the Places of Worship (Special Provisions) Act of 1991, which prohibits changing the character of religious structures on 15 August 1947.
