Chennai: With Madras High Court Tamil Nadu Higher Education Minister Punished K Ponmudi For three years Imprisonment In case of disproportionate assets, the order DMKTheir number has reduced to 132 in the 234-member Legislative Assembly.
The convention is that the Chief Minister will recommend to the Governor to immediately relieve Ponmudi of his duties and responsibilities as Minister. In turn, the Governor will accept the recommendation of the Chief Minister. The notification shall be published by the State Government in an extraordinary Gazette.
The High Court on Tuesday set aside the trial court’s 2016 order acquitting him, saying that Section 13(2) read with 13(1)(e) of the Prevention of Corruption Act against Ponmudi. The charge of the crime has been proved. The appeal was filed by the DVAC in 2017 during the AIADMK regime.
A person convicted of an offense punishable under the Prevention of Corruption Act shall be “disqualified” where he has been sentenced to imprisonment from the date of such conviction and shall remain ineligible for a further period of six years from the date of his release.
“Tamil Nadu Legislative Assembly Speaker M Appavo will notify the seat vacancy resulting from the disqualification of a member from the date of conviction and inform the Election Commission,” an official said.
